Probate Law
I have practiced in the area of probate law for over fifteen years. Upon the death of an individual, the assets in an individual’s estate are distributed from the estate through the probate process. As part of opening a probate, the will of the deceased individual names a person or professional fiduciary to serve as the personal representative (executor) to administer the estate of the deceased individual and then distribute the assets from the estate to the named beneficiaries.
In order to open a probate, an attorney must be retained to prepare and file documents to complete the following:
- Open the probate and appoint the named individual as the personal representative of the estate;
- Notify heirs of the opening of the probate and the appointment of the personal representative;
- File the notice to the creditors to ensure that all known creditors of the estate are paid;
- Lastly, file the necessary documents to close the probate.
